The Law of 30 Jan 1938

The law of 30 Jan 1938 created a new political organization of the Spanish State and formally assigned the functions of President of the Government to Francisco Franco Bahamonde:

Artículo 1.°—La Administración Central del Estado se organiza en Departamentos Ministeriales, al frente de los cuales habrá un Ministro asistido de un Subsecretario.

Artículo 16.°—La Presidencia queda vinculada al Jefe del Estado. [2] Los Ministros, reunidos con él, constituirán el Gobierno de la Nación. Los ministros, antes de tomar posesión de sus cargos, prestarán juramento de fidelidad al Jefe del Estado y al Régimen Nacional. El Gobierno tendra un Vice-Presidente y un Secretario, elegidos, entre sus miembros, por el Jefe del Estado. [3]

[3] In accordance with the decree of 2 Mar 1938 (published in Boletín Oficial del Estado, 3 marzo 1938, Núm. 499. P. 6082) Vice-President of the Government (Vicepresidente del Gobierno) was entusted with administrative functions formerly exercised by the President of the Technical Junta (Presidente de la Junta Técnica del Estado) from 3 Oct 1936 to 31 Jan 1938. The office of Vice-President was abolished in Art. 3 of the Law of 8 Aug 1939 (published in Boletín Oficial del Estado, 9 agosto 1939, Núm. 221. PP. 4326-4327) and its functions transferred to the President of the Government.
