[1]	The President of the Council of Ministers (Presidente del Consiglio dei Ministri) was designated to assume the functions of the head of state in accordance with a legislative decree of 16 Mar 1946, providing for the transfer of executive authority in case the outcome of the referendum on the form of government would be in favour of the republic. The certification of provisional results of the referendum by the Supreme Court of Cassation (Corte suprema di cassazione) on 10 Jun 1946 was deemed to have been sufficient for authorizing the transfer and the Council of Ministers approved a declaration (shortly after the midnight of 12/13 Jun 1946), authorizing De Gasperi to assume the functions of the Provisional Head of State (Capo provvisorio dello Stato), pending the election (Minutes of the Council of Ministers, 6.2:1388). The formula for legislation used during the transitional period was: "Presidente del Consiglio dei Ministri, In virtù dei poteri di Capo provvisorio dello Stato, conferitigli dall'art. 2, 4° comma, del decreto legislativo Luogotenenziale 16 marzo 1946, n. 98."
